Changes to Required Weapons Signs

As of September 1, 2021, no business is required to post the blue TABC weapons warning sign. The requirement was repealed in HB 1927.Only businesses that hold certain on-premises permits, earn 51% or more of their revenue from the sale of alcoholic beverages for on-premises consumption, and do not hold a subordinate Food and Beverage Certificate are required to post a red 51% TABC notice sign stating that a person commits an offense by bringing a firearm onto the premises. Those permits are:

• Wine and Malt Beverage Retailer’s Permit (BG)

• Mixed Beverage Permit (MB)

• Private Club Registration Permit (N)

• Retail Dealer’s On-Premise License (BE)

• Brewpub License (BP)

For all other businesses, notice signs are optional.To provided notice that the holder of a concealed handgun license is prohibited from bringing an open or concealed handgun on the premises, post the Penal Code Sections 30.06 or 30.07 notices that have been around for a few years.To provide notice that all other firearms are prohibited on the property, post an additional sign at each entrance to the property stating:Pursuant to Section 30.05, Penal Code (criminal trespass), a person may not enter this property with a firearm.The sign must be in Spanish and English, appear in contrasting colors with block letters at least one inch tall, and be displayed at each entrance in a conspicuous manner clearly visible to the public.
